Travel Services Booked Through Your Travel Agent

INTRODUCTION

These Terms and Conditions ("Terms") govern all travel services arranged on your behalf through your Travel Agent ("we", "our", or "us").

Your Travel Agent acts as your primary point of contact and facilitates your booking. Travel services are arranged through a specialist travel intermediary (the “Travel Arranger”) and are provided by independent third-party suppliers ("Suppliers"), including but not limited to airlines, hotels, tour operators, transport providers, cruise operators and destination management companies.

By requesting a quotation, making a booking, or making any payment, you acknowledge that you have read, understood and agree to be bound by these Terms.

These Terms constitute the entire agreement between you and your Travel Agent in connection with your booking, together with the terms and conditions of the relevant Suppliers.

1. ACCEPTANCE OF TERMS

You must read and understand these Terms prior to requesting a booking or making payment.

By requesting a booking, confirming travel arrangements, or making any payment, you confirm acceptance of these Terms.

If any part of these Terms is unclear, you should seek clarification prior to proceeding.

2. ROLE OF THE TRAVEL ARRANGER

The Travel Arranger acts solely as an intermediary between travellers and Suppliers.

All Travel Products are provided by independent Suppliers and are subject to the Supplier’s own terms and conditions.

The Travel Arranger does not own, control or operate the services provided by Suppliers and cannot guarantee their performance, availability or safety.

To the maximum extent permitted by law, neither the Travel Arranger nor your Travel Agent shall be liable for:
- acts or omissions of Suppliers
- delays, cancellations or schedule changes
- supplier insolvency or financial failure
- injury, illness or death
- loss or damage to property

Nothing in this clause excludes rights under applicable consumer protection laws.

3. TRAVEL PRODUCT AVAILABILITY

All travel services are subject to availability at the time of booking.

A booking is not confirmed until:
- the required payment has been received; and
- availability has been confirmed.

Bookings may be declined or cancelled where Travel Products are unavailable.

4. PRICING AND CURRENCY

Prices are quoted in Australian Dollars (AUD) unless otherwise specified.

Prices are subject to change prior to confirmation due to:
- supplier pricing changes
- currency fluctuations
- changes in taxes or government charges
- airline surcharges
- availability changes

A final price is only confirmed once booking confirmation has been issued and deposit received.

All unpaid amounts remain subject to currency fluctuations and supplier price changes until paid in full.

5. TAXES, CHARGES AND SURCHARGES

Government taxes, supplier fees and surcharges may change at any time.

Prices may be adjusted accordingly, including after full payment.

Where a material increase occurs, you may:
- accept the revised price; or
- cancel and receive a refund less non-recoverable supplier costs.

6. AIRFARES

Airfares are subject to airline pricing policies and may change until ticketed.

Airline pricing is outside the control of your Travel Agent or the Travel Arranger.

7. EXCLUSIONS

Unless specifically stated, travel prices do not include:
- airfares (unless specified)
- passport or visa fees
- travel insurance
- personal expenses
- meals not listed
- gratuities
- baggage fees
- medical expenses
- costs arising from denied entry or deportation

8. QUOTATIONS

All quotations are subject to availability and valid for 7 days unless otherwise stated.

A quotation does not constitute a confirmed booking.

9. DEPOSITS AND PAYMENTS

To confirm a booking, you must pay:
- a deposit of at least 20% of the total booking value; and
- all non-refundable supplier components.

Full payment must be received no later than 60 days prior to departure unless otherwise specified.

Failure to make payment by the due date may result in automatic cancellation and the application of cancellation fees.

10. PAYMENTS VIA TRAVEL AGENT

Payments are made to your Travel Agent unless otherwise specified.

The Travel Arranger is not responsible for funds not remitted by a Travel Agent.

Any risk associated with funds held by a Travel Agent remains solely with the Travel Agent and/or traveller.

11. CREDIT CARD PAYMENTS

Credit card payments may incur a merchant service fee.

These fees are non-refundable.

12. AMENDMENTS

Amendments must be requested in writing.

Changes may incur:
- administration fees
- supplier amendment fees
- repricing based on current rates

Certain changes may be treated as cancellation and rebooking.

13. CANCELLATIONS AND REFUNDS

All cancellations must be submitted in writing.

A minimum cancellation fee applies per person.

In addition:
- supplier cancellation fees apply
- non-refundable components are retained

Refunds:
- are subject to supplier recovery of funds
- may be reduced by currency fluctuations
- may be reduced by banking fees

Refunds will only be processed once funds are received from the relevant Supplier.

No refunds are available once travel has commenced.

14. CANCELLATION SCHEDULE

Cancellation fees apply based on the timing of cancellation relative to departure.

Non-refundable services are always retained.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law, liability is excluded for:
- indirect or consequential loss
- loss of enjoyment
- loss of opportunity
- additional travel costs

Where liability cannot be excluded, it is limited to resupply of services or cost thereof.

16. COMPLAINTS

Issues must be raised immediately with the relevant Supplier.

Written complaints must be submitted within 30 days of travel completion.

17. ACCOMMODATION

Accommodation descriptions are based on supplier information and may change.

Images are indicative only.

18. SPECIAL REQUESTS

Special requests must be made at booking but cannot be guaranteed.

19. TRAVELLER CONDUCT

Travel may be refused where behaviour impacts safety or operations.

No refund will be provided in such circumstances.

20. DOCUMENTATION

Travel documentation is issued once full payment has been received.

21. INSURANCE

Comprehensive travel insurance is strongly recommended.

No liability is accepted for uninsured losses.

22. FORCE MAJEURE

Travel may be affected by events beyond control including natural disasters, pandemics, government restrictions, war or civil unrest.

Travel arrangements may be modified or cancelled.

23. TRAVELLER RESPONSIBILITIES

Travellers are responsible for:
- passports
- visas
- health requirements
- compliance with laws

24. SUPPLIER INSOLVENCY

Suppliers are independent entities.

No liability is accepted for supplier insolvency.

25. INDEMNITY

You agree to indemnify and hold harmless the Travel Arranger and your Travel Agent from any claims, losses, damages, costs and liabilities arising from:
- breach of these Terms
- incorrect information provided
- failure to comply with laws
- acts or omissions by you or your representatives

26. CHARGEBACKS

You remain liable for any chargebacks or payment disputes.

All associated costs may be recovered.

27. AGENCY AUTHORITY

Your Travel Agent is authorised to act on your behalf and bind you to these Terms.

28. NO FIDUCIARY RELATIONSHIP

No fiduciary or trust relationship exists.

Funds are not held on trust unless required by law.

29. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia.

30. SURVIVAL

Clauses relating to liability, payments, indemnity and disputes survive completion of travel.
